Appendix 3 – Draft Traffic Regulation Order, as advertised

TRAFFIC MANAGEMENT ACT 2004

 

The East Sussex (Eastbourne) (Parking Places and Waiting, No Stopping

and Loading Restrictions) Traffic Regulation Order 2021 Amendment No * 202*

 

East Sussex County Council, in exercise of their powers under Sections 1(1), 2(1) to (4), 3(2), 4(2), 32, 35(1) and (3), 45, 46, 49, 51, 52 and 53 of, and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 (“the Act”), as amended, the Road Traffic Act 1991, as amended, Part 6 of the Traffic Management Act 2004, and of all other enabling powers and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to the Act hereby make the following Order:-

 

1.     Commencement and citation

This Order may be cited as “The East Sussex (Eastbourne) (Parking Places and Waiting, No Stopping and Loading Restrictions) Traffic Regulation Order 2021 Amendment No. * Order 202*”  and shall come into effect on xxxxxx

 

2.       When this Order comes into effect:

 

(i)           The East Sussex (Eastbourne) (Parking Places and Waiting, No Stopping and Loading Restrictions) Traffic Regulation Order 2021 as amended, shall have effect except as hereinafter contained.

(ii)         The Order Plans shall be amended as follows:

(iii)       Part I – Preliminary Interpretation shall be amended by adding the following definitions:

“car club” means a car club or similar organization (including any person or organisation acting on behalf of such club or organisation) approved in writing by the Council;

 

"car club vehicle" means a vehicle of a type approved by the Council and provided by a car club or by the Council for the use of persons who have paid any relevant membership or other car club charge and who clearly and continuously display a car club permit approved by the Council in the vehicle;

 

(iv)        Part II - Waiting and Loading restrictions and designation of Parking Places shall be amended by adding the following definitions:

Each parking place referred to in the Order Plans as being Resident Permit Holders parking places, or as being Resident Permit Holders or Time Limited parking places may be used, subject to the provisions of this Order, for the leaving during the permitted hours of such vehicles of the class specified in paragraph (1) of this Article which display in the manner specified in Article 5(2) either valid resident's or resident’s visitor permit issued in respect of that vehicle under the provisions of this Order, or where such a permit is not displayed in the manner specified in Article 5(2), the vehicle does not wait in the parking place for a period exceeding the permitted length of stay.

Each parking place referred to in the Order Plans as being Car Club parking places may be used, subject to the provisions of this Order, for the leaving during the permitted hours of car club vehicles displaying a valid Car Club permit issued by Eastbourne Parking Information Centre.

 

(v)          Part III – Supplementary Provisions Display of tickets, permits, waivers and blue badges shall be amended by replacing the following definition:

A valid permit shall be clearly and continuously displayed in a vehicle so that the VRM (Vehicle Registration Mark), permit code and expiry date, or in the case of a scratch card permit the VRM, permit code and date when parking is allowed, including the time where applicable, is clearly visible from the front or nearside of the vehicle, for its entire length of stay in that parking place. In the case of a day permit issued by a hotel or guest house acting as an authorized agent of the Council, the name of the issuing hotel or guest house shall be displayed in place of the VRM.

 

(vi)        Schedule G7 - Cost of Car Club Permits shall be inserted as follows:
